Default VVT Problems

Alright, so I found these forums on recently and discovered the letter Mazda had sent out for Mazda CX-7 2007 owners concerning the VVT, etc. So, I went through some digging and some things don't add up. I'll give a timeline of events. (Note: Currently the car has 72,000+ miles and we have a 10 year/100,000 mile warranty on the vehicle)

August 2010-(around 55,000 miles) We take the car to the dealership on suspicion of the rattling sound under the hood. They attempt to charge us over $1,000 dollars because they said the VVT is not covered under the warranty (because of the miles). Of course we don't pay and take the car home. Delivered to the shop the afternoon prior (4:00-5:00 pm) and it was picked up after 10:00 am the next day, but before 12:00 pm. The receipt has this statement on it:
REPLACE VVT..
REPLACE TIMING..
however they are not listed next to the warranty description as other parts of the receipts has the warranty information in it. And I did call Mazda Warranty about that information to confirm afterwards the reason being they couldn't fix it..and they told me that we had went over the mileage, etc.

Fast forward to now: I call the number on the VVT papers and Mazda says they don't understand why they wouldn't fix it because it is under the warranty. So, I call the dealership and they said to bring it in. We take it in and they tell us that because of the receipt that they had last..it WAS billed and they did replace it. Well, they said they would check. And guess what? It's the same problem the VVT, timing...yet they "replaced" it..so they asked us for records of our oil changes. We only did one oil change by ourselves (NOTE: this oil change was done after we brought it in to be checked by them and they said they fixed the problem). We gave them records of the 11 oil changes we had. Well, we have no record between the 55,000 and the 66,000..so they said they couldn't help us.

So, my questions are:
1. If we get an independent mechanic to take out the VVT..will there be a difference from the factory version and the new version?
2. When they supposedly fixed the Mazda before...we did NOT provide records for our oil changes as half were in the car and half were in the house. They were all separate.
3. If it was fixed, should it be going out again because of the alleged "11,000 miles" without an oil change? That's the claim they are trying to make.
4. When somebody gets their VVT fixed and the warranty covers it..what does it say on the receipt the dealer gives you. Does it specifically list "WARRANTY: 1" next to that line?

Bring receipt and letter to mazda. Get reimbursed.

File a complaint with the BBB, and find a different dealer.

If the VVT was replaced, your receipt should list all the parts that were replaced as well as the labor hours..

I seriously doubt it was changed if it's already out again...

If your state has a consumer protection agency report it to them and notify Mazda and the dealer that you have reported it. In some states this is handled by the state Attorney General's office.

State investigators take a very hard position on fraud perpetrated on a consumer and what you described sounds like a fraudulent dealer trying to bilk you out of a covered warranty claim and then lying to try to cover it up after the fact. People can go to jail over such conduct, if it happened.

State AG investigations are a part of their duty and what you pay taxes for. It would not cost you a penny, if you have such an agency in your state.

If you have proof of the oil changes up to the time you took it in for the VVT repair and they documented that the repair was needed then either (1) they did the change, but did it improperly; or (2) they did not do it because you would not pay for it and rightly so on your part; or (3) they did not do it and lied that they did.

And, unless they can prove that the oil change interval AFTER you took it in is the cause of the current problem, you are entitled to have it done right. The burden is on them to establish that the alleged extended interval is the CAUSE of the failure.

I smell fraud.

The receipt has like..what they needed to do in terms of fixing the car, but the car wasn't in their possession long enough for it to be fixed (as it lists the 4.3 hours) and oil change's receipts were never provided to them to fix the car.

We have proof that we took the car at regular intervals to get the oil changed when it was supposed to be changed. The only documented proof that the issue was brought up is on the receipt they gave us when we checked the car out (we brought it in on the 24th day of the month in the late afternoon and picked it up the morning of the 25th), but they are trying to say that it was picked up on the 27th (they have the same receipt we do and didn't show us that on Monday when we dropped the car off).

You should bring this to mazda.

Go to another dealership as well.

The warranty for 2007-2010 CX-7 with L3T engines and produced Feb 14, 2006 through Feb 26, 2010 had the warranty extended to 70k miles for these issues.

You have proof they were going to do it before. Which should of been done under warranty.

You have documentation showing you were there within your warranty. Find out when exactly your warranty expired. Call mazda.

Tell mazda how you did not have it done before because warranty was denied when it should not have been. An you were not going to pay for warranty work.

Just had all mine done recently all under warranty. I am a mazdaspeed 3 though.

But same shit.

Default Is this VVT issue only with turbo version of the CX-7?

Hello I have a 2010 CX-7 non-turbo version. The TSB states that it is for the "L3T" engine. I have looked around and I have not read anything differentiating between the turbo and non-turbo version and the issue. Thanks for your assistance.
