Breathalyzers?
 
Ahhh I feel like a tool for posting this but a friend of mine got a DUI and I am considering getting one especially since the legal limit for me is .002 which is like half a beer...

So does anyone have one? Do they actually work? Some of these are like 50 bucks and others are like 150. I just want one that works and I don't know how much I need to pay.

are you underage for the limit to be so low, cause if you are any is illegal. but n experience with the breath test. its kinda up to the cops at some point too isnt it. dont drink and drive has worked wonders for me:)

Well considering a DUI can run you 12,000 plus... I'd say go for the 150 dollar one if ur worried about it... But if ur that paranoid about it why risk drinking and driving in the first place?

I've got this one, mostly as a gimmick to see how drunk I can get lol. I wouldn't be drinking and driving at all, and if you're under age don't drink :) or get caught.

it's pretty fucking stupid to drink and drive... have seen people fuck up promising careers on account of DUIs, even if you don't crash.

if you know you are at .02 with half a beer why do you even need the breathalyzer?

Don't know what state has a .002 limit so im guessing you are underage which would be you can't drink at all. Unless you have some kind of court order

Yea WTF is .002? The federal limit is .08 if you're over 21 and that's it. .002 would be like you inhaling alcohol.

Just get your dorky friend to drive your drunk ass back. Don't risk getting caught driving. It's not worth it.

You're considering getting a DUI? Because that's what your sentence says.

As posted, just don't drink and drive. Duh. It's a simple formula. If you have anything to drink, don't drive. When you're 21, you can flex that a little. My rule is, any more than one drink and I don't drive.

SImple. Master sentences first. By the time you get that, you should be old enough to drink legally.

In addition to what everyone else said about the topic, none of those portable units are accurate enough to risk a DUI, especially if your limit is .002 (wondering if you meant .02 - a 200lb man having 1 drink would have a .002 an hour later....).

The portable units we use when we pull you over cost MANY times more than those available to the public, and we still take DUIs back for another breathtest on the Intoxilizer for accuracy.

For example: we pulled over a guy last night. Blew a .44 (no, that is not a typo) on the portable unit. Brought him back to the Intoxilizer and blew him agani (within the same hour) and he was at .36
Normally it would take about 5 hours to drop that far in BAC. Just goes to show the handheld ones can give an idea of BAC, but nothing to rely on totally.


*No, these formulas for weight, drinks, etc do not apply to anyone. They are a good indicator for the general public, however.

Ok to clarify:

I am not saying that I planned on going out and getting slammed to get in my car and try to get the highest possible BAC. I am saying that if I end up in a situation where I have had something to drink without it being excessive and I need to drive, I want to know exactly where I stand with the law. There have been plenty of times where I have had 2-3 beers and then 3-4 hours later I want to drive home. At that point I obviously feel fine but don't know what would happen if I were to get pulled over. You all are blowing this out of proportion...

Post if you have something constructive to say about the practicality/accuracy of breathalyers.

One of my friends has a 50 dollar one her and her boyfriend got from sharper image.

We were blowing into it as a joke and I blew a consistent .07, but definitely knew I was still way too buzzed to drive. (not that I would anyway)

Personally I wait 2 hours after my last beer if Im drinking socially (as in not getting shitfaced), and the only place I really drink is at my friends house which is down the street.

Honestly, dont even risk it. Its simply not worth it. You can blow a .07, but if a LEO still thinks youre too intoxicated to be on the road, im sure hell still stick you with a DUI.

My coworkers son just got pulled over on monday for a DUI. Hes 19. Had to sit in jail overnight and wait to be bailed out on his dads dime. He has a temp license for a month and then hes SOL. Hes putting his family in thousands of dollars in debt (mind you his dad is a great worker, but doesnt make that much). He cant drive for at least another year, and he has to put on all his applications from here on out that hes had a DUI.

I think my BAC is .02 just thinking about the beers in my fridge.

NCZ13 makes another good point about still being charged if the LEO thinks you're too drunk.

In some states, Driving under the influence and Driving while intoxicated are two separate charges.

In Virginia, if your driving indicates you may be drunk (swerving, erratic behavior, etc), I can pull you over for suspicion of DUI/DWI.

Suppose you fail the SFST (standard field sobriety test) but pass the breathalyzer; I can't charge you for DWI, since you did not meet the threshold BAC, but I can still charge you with DUI, since your actions still indicate you were too messed up to drive. We can stack both of them on too (if you also fail the breathalyzer), but AUSA (assistant US attorney) will often drop the DUI charge, since it's the lesser, in pursuit of the DWI.




This is my recommendation: if you want to be totally safe and not worry, do not drive at all after you drink. Arrange alternate transportation for the night. Simple as that.

I think you're getting your signs <> wrong. The Florida Zero Tolerance level of .02 is for drivers under (<) 21. If you're dumb enough to underage drink and be outside your house, let alone be driving a fucking car, you deserve more than a DUI.

I almost posted my experience with having to use a breathalyzer because of a DUI and was even going to point you to the ones that I had to use in PA, but clearly you shouldn't even be drinking let alone drinking and driving. Thus:

Spot on info right there ^^. In SoCal, I'm not even required to use a 'breathalyzer" in the field. If you don't pass my SFST's, end of story, you're done. You can be offered a breath or blood test prior to booking, however we often only take blood for evidence. An officer's notable observations are all that are needed initially.

Those cheap breath units suck and are good just having fun with your friends at parties.

Call your mom and have her come pick you up if you drink.

Its the Same in Texas the officers judjement is all that is needed... but A DUI will eventually be dropped in court if FST and breathalizers/blood tests are refused. It is still a HUGE PITA. . especially if they are looking for .02 thats gonna be really hard to prove without a breathalizer or blood. Know your rights. Better yet DO NOT drink and drive

I tried to drive when I was hammered once. I ended up sitting in the car for 20 minutes wondering how I was going to negotiate that particular task given my state of mind.

Needless to say, I was smart enough to get out of the car and return to the party.

No matter how drunk I ever was, I always knew when attempting to drive was a bad idea. People who drink and drive are ignorant morons who have no self control or self awareness. Simple as that.
