Got a Ticket.
 
So I got a ticket tonight at 2am for going "73 in a 50"
I also got a ticket for "Driving Unsafe Vehicle". I was told snow tires are not a stock part and are NOT aloud on ohio roads. Ordnance 33701A.
I was not speeding. I do have snow tires installed.
Before I left where I was before I got pulled over I watched a cop sit in front of my car and my buddies car and write down both of our licence plate numbers. The ticket also says that there was "moderate/heavy" traffic. Are you fucking kidding me? Its 2am.

Anybody know a good lawyer in ohio? This is BS.

Edit- I did assert my rights after the ticket was given. The cop would NOT show me the radar or his badge number nor name.
I was told to quit watching NYPD blue because thats just crap on TV.

No number on the car. Lights in the cop not on top.
Nothing more then a "Aurora Police" on the side of the car. I suspect the car # was on the rear plate but I obviously could not see that nor was I allowed to.

Name and number should be on the ticket, Is it? I don't know about tickets in the States, never had one there.

Odd, well you still have to fight this crap. It's bullshit cops like that that make all of them look like douche bags.

Makes me mad because they look for people with nice cars and just because they drive a shitty car or their life sucks they go all and mighty on people.

Make sure you sign the back of the ticket send it in and fight it. Also tell them in court what the asshole/ sorry, officer said to you and the details in which occurred. I would even go to the police department and ask to speak with the officer in charge or even go to the city hall or even mayor office and ask how you could file a complaint. If you saw his face you can try and do a search online or do some research for pictures of police officers. That way you know how to file against that officer name.

same as the above posts... i only know about stuff in the states...but seems his badge number and usually the beat he was on should be on the ticket. how else would they know who actually wrote the citation?

if you went to the office seems it wouldn't be that difficult to track him down if you really want to

Been there done, gone that that road before. 10k later nothing happened.
Theres no point in taking a personal vendetta against the cop himself. Corruption is in in Aurora.
If anybody here is local to Ohio that has some legal advise Id appreciate it.

Regardless of that, he has no proof of your speed. Which makes a better case for you. And you can also request the dash video which should have recorded his conversation.

The problem is attorneys cost money. The cop knows this; most tickets aren't worth fighting in court. You could fight it yourself, might be worth it in this case; some judges hate dickhead cops like that as much as we do, and most judges aren't stupid; they'll see through the bullshit. Of course it really helps if you have witnesses.

No witness. I don't think I would have had such a problem had I had a witness.
I asked for the radar, he told me its not my right to ask for that and I need to get my facts straight. Last time I had a problem like that the tapes mysteriously went missing. Yet I still lost.

Oh and the ticket says, radar, VASCAR, and laser.
So which is it?

Take it to court anyway, as long as it doesn't inconvenience you. The "officer" will have to be there too. At least you can inconvenience him a little. Might even win. Especially if he can't provide any evidence of your speed. It all depends on the judge.

Corruption is big around here.
The judge I need to go in front of nailed me with a drag racing incident when I was younger. I lost my licence and was under house arrest for 12 months. I was not guilty! I was found to be innocent yet still had to "serve my time"
Keep in mind I was not even in the same city at the time of this incident. The judge told me the other kids were to hooked up and got off free, somebody had to take the blame and since I was the last one in the court room I got nailed.
I am NOT a fan of the justice system.

If theres any traffic lawyers at MSF. please let me know your thoughts.
As I understand it the use of VASCAR would require the notation of the point of reference and seconds time. There is no such thing. Keep in mind the alleged location of speed is in a very wooded area around a set of sharp bends. The officer was pointed the opposite direction. Things just don't add up here.

Not cool but here in ct they do not have to show you the radar. Send it in not guilty and take ur chances with the prosecuter.. might be able to get out of it based on the ticket being incorrectly filled out.

Also, studded snows are not allowed in CT during certain dates were ur tires studded?

I don't know what to say, if you get the wrong Judge you may more trouble. It's what I get from what you wrote...If it's that bad and you have a lot on your record, well pay the man.

No not studded. They were bought locally.
The cop in question also had the same brand of snow tires installed on his car. They were easy to see in the rearview.

Im not paying and im not getting nailed for something wrong like this.
The court date is mandatory and maximum fine is 10 years licence suspension, up to 100k in fines and possible 2 years jail time.
All because I was driving 53 in a 50. Slow down guys, and dont forget to keep your summer tires on in the winter.

Oh and my record is clean that happened when I was 17. I'm now 25.
I've only had one other speeding ticket when I was 18. 66 in a 60. 2 points and a 300$ fine.
That should have dropped off my record though as my insurance doesn't see it.

Actually come to think of it, I had another ticket for 61 in a 60 that I tried to fight and lost when I was 20. The judge was gonna "teach me a lesson"

It is what it is....Less then a week before the new year. Gotta hit that quota. 76 pull overs in aurora between midnight and 8am. (just got the numbers from the police station) Excessive much??? I mean it is one of the biggest bar nights in aurora all year. 3 hrs to get a drink...pffft. I didn't even get a drink with my burger because there was such a wait.
Oh and im apparently not aloud to drive my car AT ALL until the court date has passed due to the "driving unsafe vehicle" charge. Otherwise my licence will be suspended until further notice and i will get another charge..?

Either the courts and cops are hugely corrupted, or you aren't telling whole the story. I don't get how you can be found innocent of drag racing yet have to serve your time and lose your license, that makes little to no sense.

As far as I can tell, studded snow tires and tire chains are illegal in OH, but there isn't even an ordnance 33701A listed anywhere.

Tell you what--I'm going to ask some Ohio LEOs about that law and see what they say.

they don't have to show you radar. its a safety issue, so noone does it anymore.

and to get the dash cam video you typically need a warrant to retrieve it...or there needs to be an investigation.

cop doesn't need proof of speed for court, only a sworn testimony/statement saying he used a calibrated radar gun.

sounds like he gave you the ordinance stating you couldn't use snow tires, look it up...if its true then you can't fight that.

If he's doing his job correctly the calibration records of the unit should be logged with his dispatch records. In most states these are public records and can be requested at the local station or court house. We test our guns before issue and at turn in, it's then logged in the book by the receiving individual and the gun bunny inside the cage. Vehicle mounted units usually have the same format. It's supose to ensure proper detection with the unit. Even if he signed his name unclearly, all tickets are tracked once assigned a number. I have seen digital summons, and ticket books. More than likely a ticket book is assigned to an officer, between x number and x number he/she is responsible for. When one fails to show up, the officer is usually questioned, most will even turn in mistakes to keep from looking like they are hiding stuff. I agree, get smart on the laws, get the certification records for the car or unit, usually the officers training records are public record as well, depends on how much digging you want to do. If it turns out that they are not certified to use that unit or it wasn't calibrated properly for the weather/road conditions, you might win. Most people don't know that there are set spefications to running radar/lazer. Corners, hills, and other man made issues have to be factored in. He might not have wanted to show you the unit, because they usually show the patrol cars speed as well. Food for thought. Good luck with it all. They are right about the lawyer being expensive, but it might pay off in the end.

title 55 has to do with highway laws and the only one talking about snow tires is the following

Here's what i would do... you seem intelligent enough that you know your rights... look at it this way... your screwed if you dont go to court...or if you lose in court... I've been through this many of times. sign your ticket not guilty and it send it in with the $50 collateral. When your court date comes...try and get a continuance and prolong the hearing... gives you more of chance the cop will forget. When the day of the hearing comes dress nice, be polite, and just explain EVERYTHING in detail the magistrate. Considering its only a traffic citation it's only gonna be a magistrate. Chances are, since you had snow tires and not studded... youll prolly have that charge dropped and if you play your cards right and explain you werent shown the radar or anything... you may have the speed dropped or at worst... it'll be taken down from 20 to 10 over the limit.

I skimmed through and I have to say I don't even believe this story lol.

If it did happen, subpoena the video/audio from the incident.
You don't need a lawyer for that.
Also get a copy of the police report and subpoena the radio traffic recording.
I would also subpoena the means and method of tracking your speed.
Make sure you request the calibration date as if they're not calibrated regularly, the results are deemed inadmissible in court.
Subpoena any traffic reports for the area to disprove his "moderate/heavy," traffic comment as well (if available.) If none are available, rent a camera and go out at 2 a.m. for the next week or so and record the traffic with a tripod.


Last but not least, record your hearing on your phone or something so we can hear wtf happened (just hit record and set it on the table.)

If the results are unsatisfactory and/or clearly biased, give the tape to the local news and request an investigative report be commenced to follow up on corruption.

According to that pdf, the applicable statute should be 339.11. http://rrcity.com/ord/339.pdf

Correct me if I'm wrong, but doesn't this only apply to "Commercial and Heavy Vehicles?"

Under cross references, it says "use of studded tires and chains, see TRAF. 339.11
