I'm sure 99% of law enforcement is legit and there to serve the general public.

There is always that 1% that are the bad apples and give the profession a bad name. (just like every other profession)

I'm espcecially incensed at rogue law enforcement , for my own selfish reasons though.

Whats not to believe? Had I gotten a simple ticket for going over the speedlimit that I was guilty of I would have just maned up and payed it with a smile. This however is not the case.

I will ask for the audio/video. But that doesn't mean it will actually show up. Last time I had tapes subpoenaed in, they mysteriously got "misplaced"

Im not willing to move away and buy another car just because some cops has a personal vendetta because I challenged his authority.

All right, Today I took pictures of the location where I got the ticket, took pictures of my tires (winter tires on steelys) and pictures of my stock tires. Got some of the bumper height with a ruler too. Had 2 separate lawyers take a look at the actual ticket to. Both told me that its just a bunch of nonsense.
General rule of thumb around here. Dont go out late after Christmas before the new year.

Sounds like a bunch of BS as others have said. Hope it gets sorted out.

After talking to a couple lawyers it seems the cops just lying through his teeth and Im still aloud to drive regardless of what they said. Ill be going to my local tire/lube place (that i used to work at) tomorrow to have them confirm that my car is at stock height and my tires are legal.
That should handle the one charge and ill just have to battle out the alleged speed. Cross your fingers.

Even 'studdable' snow tires are legal for passenger cars (without studs), as long as they meet DOT spec... dude's mouth was full of jizz when he spun that one. In fact, summer/R compound tires could be deemed 'unsafe' if they aren't snow rated. If it's because they weren't OE equipment making it an 'unsafe vehicle,' then the majority of the cars on the road would fall into the same category, snow tires or not.

Subpoena dash-cam and/or audio for when you go before the magistrate. BE CALM, and state your case RESPECTFULLY and COMPLETELY. Use flash cards as speaking points if you need to. Make sure he knows the donut jockey referenced an ordinance, but was unable to produce it. Also, accusing and 'finger-pointing' will get you thrown out... trust me. If they will play the video/audio, let that speak for itself.

Not a fun position to be in, I know. Keep us posted, maybe we can all learn a little from the outcome!

When I called in to the police station yesterday morning I was told they "only record when via dash cam in a situation when they feel they are threatened" BS im sure, but i may not be able to get the audio or anything.
Plus the receptionist told me chances are the audio did NOT pick up any speech from my car even if they do have video. She said that wouldn't be able to be subpoenaed unless I was against criminal charges and it went to a full trial.

Ill still try but it doesn't sound good. Im just trying to take all the pictures and get all my information in line before I go in.

Good Luck with this. Most cops I know are really nice people. Some have even volunteered to help with the occasional ticket. I paid the last one though...got hit with LIDAR doing 78 in a 50..he knocked it down to 55 in a 50. Remind me to stay the hell out of Ohio.

Go to the station and ask to see the duty log, find out who was working and you'll figure out who pulled you over. Your entitled to all that information, they can't deny you looking at it.

When you ask for the video/audio, you need to do it in writing, check the Ohio public records access laws, so that you follow the request guidelines in the statue to a tee. If you do that and they fail to comply, you can use that against them in court and probably get sanctions on them for failing to comply.

Second, check the laws regarding the cop showing his name/badge number. This is a big issue because you could think he is impersonating and feel unsafe, especially at 2am. He cannot deny he didn't provide that because you don't have it anywhere in legible writing. Do your homework on all the statutes and be prepared.

His name and badge # are on the bottom of the ticket, and snow/studded tires are aloud in Ohio on certain months - I belive that started some time back in November...what the fuck town was this in bec I think I'd like to call that PD and tell that officer what a fuck he is for going far above and beyond a simple speeding ticket - so no offense, either your lying out your ass or the cop is a dumb mother fucker, btw I am a cop - in Ohio lol

I remember coming into Ohio this past year during the night, about 11:00 PM. I was cruising along on Hwy 70 East of Columbus doing about 15mph over the posted prima facie limits. All of a sudden a police officer drives up beside me out of nowhere and flashes his lights. I roll down my window and he says, on the speaker, "dad, can you slow it down a little! Yeah, I guarantee that encounter was recorded. Now, whether or not it was erased afterward is another story.

I would ask to see written department policy on the use of dash cams during stops. My guess is it says to record ALL OF THEM. He would once again be in violation of dept policy.

I only know for a few cities in North Carolina (Charlotte, Concord, Huntersville, and Cornelius), but in these cities, any time the blue lights go on, video is being recorded. A step further, in Cornelius, officers have control of the audio, but if the blue lights are on, video still runs.

Like ^he said though, thats all on a VHS, so what happens after the video is recorded is all up to "discretion" and "policy"

They are right about the lawyer being expensive, but it might pay off in the end.

Well if you calibrate your guns at your station and dont send them out to a third party for calibration then your doing it wrong. law stated that you have to send them out to get calibrated.

The "quota" depends on certain areas. I know for a fact, Baltimore City has a quota. I've worked with city swat team members on side jobs and played paintball with them in practice scenarios. We've had many discussions about this. I've been told Baltimore County doesn't have quotas. Just food for thought.

there should be a court date on the ticket that you can go and fight. if so you go if that cop does not appear charges are usally dismissed. but get a lawyer just in case
