All states are different, but in NC I know that if the car is less than a year old they have to use new OEM parts, after a year they can do what ever used or aftermarket.:jerkit:

The appraiser won't arrive until sometime next week. It is at a Mazda dealer right now and the body shop guy says they will do whatever the appraiser decides, whether OEM or aftermarket. He also said he will step in if he feels the appraiser is off in the estimate, but I doubt he will challenge the appraiser to total the car, then the body shop don't get paid.

Also, my insurance company gave me a choice I can either do the repair at the mazda dealer or go to their approved location (not mazda dealer). The benefit of going to their approved location is they will pay my rental if the repair takes longer than a month. But the drawback I believe is they will do the cheapest work since they are affiliated with the insurance company. And like I said before the body shop guy at the dealer is not going too step in and say its totaled cause then the dealer does not get paid...Which one should I chose? According to dealer estimate they said it should take 3 weeks because they are in a slow timeframe...BS? Might bite me later on if they go over?

Thanks guys for your opinions, but the car being totaled is looking more like a pipe dream. Wonder if Jalopnik will like this lol

This is true of all body shops including dealer's. They will all try to do it as cheap as possible, but the dealer will use the most OEM parts as possible. They can get them internally for less then retail and will usually have most on hand. Where most aftermarket parts they have to buy at what everyone else does and they wil have to wait for them.

Sorry to hear, and dont be surprised when the apprasier says it's a total loss. From the pics it looks like there is just too much structural damage to be worth fixing. just my .02

Hell, an 08 or 09 was in a little fender bender a few months back and it was totaled. This shit is FUBAR. It needs to be totaled.

That should be a totalled claim. Basically the whole front end is fucked, suspension, frame, pillars and hopefully nothing happened to the engine. Good luck but I will agree this goes down as one of the stupidest women driver stories I have seen or heard.

Go down and swap out the mods. Once they total it, most of the time you cannot touch or go near it.

Yup - that is fuckin totaled to no end.

An assflute drove over my Integra a few years back - my car was parked at the curb with the wheel turned towards the curb and his fuckin Festiva caught my turned wheel and he drove over it.

There was not much damage if you look at the car - the suspension blew right away but that's cuz it was 13 years old; I had some dents on my fender, a dent on my door - but it was still driveable.

However - there was a TEENY TINY kink in the frame; the hood was pretty dented and a small dent in the a-pillar. Farmers, the other guys insurance, totalled it on the spot - the quote to repair it was close to 7 grand and the car was worth 4 (I got 5).

Obviously you can't compare a 13 year old car at the time to a 1 year old car however your car's damage is SIGNIFICANTLY worse than mine; I'll be surprised if they decide to repair it.

This really sucks dude. I don't see how you can be pulling in the parking space and hit the gas... why would your foot be near the gas?? I would have asked to see her license for information then thrown it out of the parking garage. Fucking dumb bitch.

OP, sorry about your car. If insurance does decide to fix it, chances are you will get all OEM parts. I don't think there are any aftermarket body parts companies that made pillars and MS3 hoods yet. Fenders, maybe, but probably not. It's not like it's a Civic and there's millions of them.

Oh, and I noticed that it looks like they pulled the Nissan out backwards off your car. I would have gotten in the MS3 and reversed out, letting that Altima drop into your parking spot!

Sure hope the dealership aren't asses about it and void the remainder of your warranty do to the SRI/TIP. That sucks man. Hope all goes well but I would at least try and bullshit someone into a new car vs repair

At 2 a.m. I was awoken by the local PD saying my car was in an accident. I woke up from my slumber and I started scratching my head. Then I thought to myself well maybe someone pulled in and accidentally hit the back of it, maybe a minor scratch.
A Nissan was on top of my hood and windscreen! Still drowsy at the moment, my first reaction was, oh no, I hope my corksport SRI/TIP is ok, it took me forever to install it... And then reality kicked in and OMG a sedan is parked on top of my baby!

I actually go to PSU. This happened in state college. Regarding some of the questions, the girl that was driving was not drunk, just plain stupid. I appreciate everyone's optimism about the possibility of the car being totaled. But most likely this will not happen according to the body shop guy at the dealership. My hopes if they do repair it, they will use only OEM parts and not stupid fabricated replicas.

And the reason I sent this in to Jalopnik was to hopefully shine more light on it to my insurance company, hopefully it will pressure them to write it off :), but just a dream.

And I may consider another speed 3, I do LOVE IT! I will keep you guys updated.

maybe i missed this because i'm an idiot, but isn't this going through her insurance company? you need to read up on your legal rights in PA, every state is a little different but you need to be informed before you talk to the adjuster. i've dealt with shady ones and stupid ones, either way can have a negative outcome for your repair. there are also some that are courteous and professional, but remember, they represent someone who has a vested interest in your repair being settled for the smallest dollar amount.

first off it is the body shop's decision to use oem or not....they give the insurance adjuster the quote...not the other way around (unless it is a clear total)...you tell the body shop you want oem and that is what they will quote for....if they wont then switch body shops.....why did you take it to the dealer anyway?.....they suck at everything

and another thing...you tell those fuckers it is totaled....unless that dealer signs something saying they are liable for the structural integrity of the roof after those welds...you tell them to fuck off and you are not driving around with a welded on roof
